INTRODUCTION
These Terms of Use explain the rules for using ConSolves.
ConSolves is a construction work marketplace that allows contractors, hirers, workers and subcontractors to discover construction work opportunities and connect directly.
ConSolves is designed to make it easier to:

ConSolves is an intermediary/platform.
Unless expressly stated otherwise, ConSolves does not itself:
- employ workers
- supply workers to sites
- supervise workers
- manage construction sites
- direct how work is performed
- guarantee the quality of work
- guarantee that a job will be completed
- guarantee payment between users
- determine employment status
- provide tax advice
- provide legal advice
- provide health and safety advice for a specific site
IMPORTANT
The fact that a person uses ConSolves does not determine whether they are an employee, worker, self-employed person, subcontractor, contractor or another legal category.
Employment and tax status depends on the actual circumstances and relationship between the relevant parties.

ConSolves may operate under the trading name "ConSolves".
2. ACCEPTING THESE TERMS
By creating an account, accessing the platform, posting work, responding to work or otherwise using ConSolves, you agree to comply with these Terms.
If you do not agree with these Terms, you must not use ConSolves.
If you are using ConSolves on behalf of a company or another organisation, you confirm that you have authority to accept these Terms on its behalf.
3. ELIGIBILITY
You must provide accurate information when creating an account.
You must be legally capable of entering into agreements applicable to your use of the platform.
You must not create an account using another person's identity or information without permission.
We may restrict access where we reasonably believe an account has been created fraudulently, deceptively or in breach of these Terms.
4. WHAT CONSOLVES DOES
ConSolves provides technology that allows users to:
- create work listings
- discover work
- express interest in work
- connect with other users
- exchange contact information where permitted
- communicate outside or through available communication tools
- report jobs or users
- manage their own account and listings
ConSolves does not become a party to the construction contract between users merely because it facilitates an introduction.
Any agreement concerning the actual construction work is between the relevant parties.
5. USER-TO-USER AGREEMENTS
When a contractor/hirer and work-seeker/subcontractor agree to work together, they are responsible for agreeing the terms that apply to their relationship.
Those terms may include:
- scope of work
- price
- payment arrangements
- dates
- working hours
- materials
- tools
- equipment
- responsibilities
- insurance
- qualifications
- health and safety
- tax
- CIS where applicable
- employment status
- cancellation
- variations
- completion standards
ConSolves does not automatically create or approve a construction contract between users.
Users are responsible for obtaining professional advice where necessary.
6. EMPLOYMENT STATUS
ConSolves does not determine whether a person is:
- an employee
- a worker
- self-employed
- a subcontractor
- a contractor
- an agency worker
- another legal category
Users must not rely on the ConSolves platform, job labels or payment method alone to determine their legal status.
The actual working relationship and applicable law determine status.
7. JOB INFORMATION
Users posting work must provide accurate information.
Depending on the job, information may include:
- work description
- trade
- quantity
- location
- start date
- completion date
- duration
- working hours
- price/payment basis
- required experience
- qualifications
- training
- authorisations
- PPE
- known safety information
- materials
- tools
- crew requirements
- photographs
Users must not deliberately hide material information that could affect someone's decision to take the work.
8. PHOTOGRAPHS
Users may upload photographs where the feature is available.
Users must have the right to upload and share those photographs.
Do not upload:
- another person's private information without permission
- confidential documents without permission
- images that unlawfully expose personal information
- illegal or prohibited content
Photographs may help explain work but do not replace the user's responsibility to provide required written information.
9. CONTACT BETWEEN USERS
Depending on the platform features and user preferences, connected users may communicate by:
- phone
- exchanged contact details
- other communication methods made available by ConSolves
Contact information must not be publicly displayed unless the user has deliberately chosen to make it public.
Users must respect other people's privacy and must not use contact information obtained through ConSolves for spam, harassment or unrelated marketing.
10. FEES
ConSolves currently does not process construction payments between users through the platform unless a specific feature expressly states otherwise.
Users are responsible for agreeing payment arrangements directly with each other.
If ConSolves introduces paid features in the future, additional terms or pricing information may apply.
No user should be charged for a service unless the applicable fee is clearly disclosed before the charge.
11. TAX AND CIS
Users are responsible for their own tax obligations.
Where the Construction Industry Scheme or other tax rules apply, the relevant parties are responsible for complying with those requirements.
ConSolves does not currently calculate CIS deductions, operate payroll or act as a tax adviser.
12. HMRC DIGITAL PLATFORM REPORTING
Depending on how ConSolves operates and the transactions facilitated through the platform, digital-platform reporting obligations may apply.
Where applicable, ConSolves may be required to collect, verify, retain and report information about users to HMRC or another relevant authority.
Users agree to provide accurate information where legally required.
Required information will be handled in accordance with the Privacy Notice.
13. VERIFICATION
A user may provide information about:
- identity
- qualifications
- cards
- training
- experience
- insurance
- business details
Unless ConSolves expressly states that information has been independently verified, users must not assume it has been verified.
Labels such as "Verified" will only be used where the relevant verification has actually been completed.
14. CONSTRUCTION HEALTH AND SAFETY
ConSolves is not a replacement for:
- risk assessments
- method statements
- site inductions
- construction planning
- competent supervision
- PPE
- site controls
- CDM duties
- statutory health and safety duties
Users remain responsible for the legal duties applicable to the work they control.
Job posters must provide relevant known information about hazards and requirements.
Work-seekers must only accept work they are suitably capable, trained and legally able to perform.
15. PROHIBITED USE
Users must not use ConSolves for:
- illegal activity
- fraud
- scams
- fake jobs
- fake qualifications
- fake documents
- discriminatory job advertisements
- knowingly unsafe work
- harassment
- threats
- abuse
- misleading listings
- impersonation
- attempts to circumvent legal requirements
- unauthorised use of another person's information

16. REPORTING
Users can report jobs or accounts where reporting functionality is available.
Reports may concern:
- fraud
- scams
- unsafe work
- discrimination
- harassment
- fake qualifications
- illegal activity
- misleading information
- other prohibited content
ConSolves may investigate reports and may take proportionate action.
17. SUSPENSION AND TERMINATION
We may restrict, suspend or terminate an account where we reasonably believe that:
- these Terms have been breached
- the account is being used fraudulently
- the user presents a serious safety or legal concern
- the account is being used to abuse the platform
- information supplied is materially false
- the law requires us to do so
Where appropriate, we may remove individual listings without terminating the entire account.
18. PLATFORM AVAILABILITY
We aim to keep ConSolves available and functioning, but we do not guarantee that the platform will always be:
- available
- uninterrupted
- error-free
- secure from every possible threat
We may temporarily suspend features for maintenance, security, upgrades or other operational reasons.
19. USER CONTENT
Users remain responsible for the content they upload.
This includes:
- job descriptions
- photographs
- profile information
- qualifications
- business information
- messages or other content submitted through ConSolves
By uploading content, you confirm that you have the necessary rights and permissions to provide it.
You grant ConSolves a limited licence to host, store, display and process that content as reasonably necessary to operate the platform.
This licence does not transfer ownership of your content to ConSolves.
20. INTELLECTUAL PROPERTY
The ConSolves platform, branding, logo, design, software and original platform content belong to ConSolves or its licensors unless stated otherwise.
Users must not copy, reproduce, modify, distribute or commercially exploit ConSolves intellectual property without permission.
21. THIRD-PARTY SERVICES
ConSolves may provide links or integrations to third-party services such as WhatsApp, email providers or other communication services.
Those services are operated independently by third parties and are subject to their own terms and privacy policies.
ConSolves is not responsible for the operation of third-party services.
22. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
This includes liability that cannot legally be excluded or limited.
Subject to that, ConSolves is not responsible for:
- the acts or omissions of users
- the quality of work performed by users
- whether a user is suitably qualified
- whether a job is completed
- disputes between users
- payment disputes between users
- damage caused by work performed by users
- losses arising from a user's failure to comply with their own legal obligations
Users should carry appropriate insurance and obtain professional advice where appropriate.
23. NO GUARANTEE OF WORK
ConSolves does not guarantee:
- that a job will receive interest
- that a contractor will find a suitable person
- that a work-seeker will obtain work
- that a connection will result in a contract
- that a user will be paid
- that work will be completed
- that a user is suitable for a particular job
24. CHANGES TO THESE TERMS
We may update these Terms when reasonably necessary.
If changes are material, we will provide appropriate notice where required.
The updated version will display a new "Last updated" date.
25. GOVERNING LAW
These Terms are governed by the law of England and Wales unless applicable law requires otherwise.
The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply to a user.
